Using jurisprudential, economic and sociological analyzes this paper studies the concept, arguments, criteria and obstacles of dynamics in contracts. The findings show that, contracts are a dynamic part of wealth distribution in Islamic economics. Three types of reasons for this dynamism can be proposed, I) socio-economic arguments based on the analysis of dynamic social needs, II) jurisprudential analysis, such as the signatory nature of rulings and non-primitiveness of contracts and the existence of manteqatul-firaq in the jurisprudence of transactions, III) verbal arguments, such as verses 5:1; 17: 34; 2: 177 and 4: 29 and the hadith of Condition. Dynamic criteria in inventing include, guaranteeing the goals and structures of Shari'a and the composition of contracts, compliance with the Book of God and the requirements of the contract. Neglecting the new contracts and the existence of scientific and practical obstacles such as lack of social responsibility for jurists are among the reason for the stagnation in the formation of new contracts. The trustee for designing designing new contracts is the Guardianship. ضرورت طراحی سازوکارهای مشروع در راستای اهداف شریعت در حوزه قراردادهای مالی، اهمیت پویایی در عقود را نشان می هد. این تحقیق، با استفاده از تحلیل های فقهی، اقتصادی و جامعه شناسانه، مفهوم، انواع، ضرورت، ادله، ضوابط و شبهات پویایی در عقود را برمی رسد و در مورد متصدی طراحی عقود به قضاوت می نشیند. طبق یافته های تحقیق، عقود بخش پویای توزیع ثروت در اقتصاد اسلامی است. سه سنخ دلیل بر پویایی قابل ارائه است: 1. ادله اجتماعی ـ اقتصادی مبتنی بر تحلیل نیازهای پویای اجتماعی منجر به شکل گیری عقود. 2. تحلیل های فقهی، چون امضائی و غیرابتدائی بودن عقود و وجود منطقه‌ی الفراغ در فقه معاملات. 3. ادله لفظی، چون آیات 1 مائده؛ 34 اسراء؛ 177 بقره؛ 29 نساء و حدیث شرط. ضوابط پویایی در ابداع، تضمین اهداف و ساختارهای شریعت و در ترکیب عقود، عدم مخالفت با کتاب الله و مقتضای عقد است. رکود در شکل دهی عقود نوین، ناشی از عدم احساس نیاز به طراحی عقد جدید با وجود عقود پیشین، وجود موانع علمی چون تصور توقیفی بودن عقود یا موانع عملی چون عدم وجود مسئولیت اجتماعی برای فقهاست. متصدی امین جهت طراحی عقود نوظهور، نظام ولایت است. https://marifat.nashriyat.ir/sites/marifat.nashriyat.ir/files/article-files/3_64.pdf
