This strategy is the best way to create harmony and empathy and overcome family challenges and is one of the masterpieces of Islamic Sharia. This research, while explaining the position of arbitration in family affairs, criticizes the functioning of this institution, focusing on the characteristics of family lawsuits, and also criticizes the challenges of this institution, and finally, solutions to create a compromise between couples. and provides consolidation of the family foundation. به لحاظ اهمیت و جایگاه رفیع خانواده در اسلام و ضرورت تحکیم این نهاد مقدس، بخشی از فعالیت داوری به دعاوی خانوادگی اختصاص یافته است.داوری برای حل اختلافات بین زن و شوهر از دیرباز مورد استفاده بوده و دارای مزایای بسیاری است، اما متاسفانه تنها کاربرد عمده آن در قوانین فعلی بر خلاف قوانین گذشته، در هنگام طلاق است.قرآن کریم در آیه 35سوره نساء، به داوری در دعاوی خانوادگی اشاره نموده و به خویشان زن و شوهر این اجازه را می دهد که با دیدن ناسازگاری و مشاجره بین زوجین، یک دادگاه خانوادگی تشکیل داده و با حضور زوج و زوجه بین آنها مصالحه و توافق برقرار نماید.این تدبیر بهترین راهکار ایجاد وفاق و همدلی و پشت سر گذاشتن چالش های خانوادگی و از شاهکارهای شریعت اسلام است. این پژوهش ضمن تبیین جایگاه داوری در امور خانواده، کارکرد این نهاد را با محوریت ویژگی های دعاوی خانوادگی، مورد نقد و بررسی قرار می دهد و همچنین چالش های این نهاد را در بوته نقد قرار داده و در نهایت راهکارهایی در جهت ایجاد سازش بین زوجین و تحکیم بنیان خانواده ارائه می نماید.
