In the present study; The concept of pre-sale and its rulings have been explained and the compatibility of pre-sale with pre-sale has been examined in this section, as well as the ways to overcome these problems; Among them, pledge, future sale, priority and preemption, participation in production and creation were stated by jurists, which have been investigated and analyzed. This research using Descriptive and analytical research method has been done and its data has been collected and analyzed using library tools and resources in both software and hardware formats. Therefore, the most suitable strategy for pre-sale of goods in the traditional market and commodity exchange, which is in accordance with Islamic jurisprudence, is Istisnaa contract and its use in the commodity exchange is done in the form of documents, which is explained in this research پیش فروش ، معامله است که امروزه در نظام اقتصادی و تجاری تمامی کشورها از جمله ایران رایج است. که هم بر عقد غیر معین از جمله؛ تعهد به ساخت و تملیک مطابق است و هم بر بیع سلف در زمره عقود معین است و همچنین پیش فروش، از انواع معاملات پذیرفته شده و مشروع در فقه اسلامی است و از معاملات رایج و متداول در بازار سنتی و بورس کالا جهت فروش محصولات تولیدی انجام می گردد. در پژوهش حاضر؛ مفهوم پیش فروش و احکام آن بیان شده است و تطبیق پیش فروش با بیع سلف درفقه بررسی شده همچنین راه کارهای که جهت برون رفت از این اشکالات ؛ ازجمله؛بیعانه، بیع آینده،اولویت و حق تقدم،مشارکت در تولید واستصناع توسط فقها بیان شده ، که مورد بررسی و تحلیل واقع شده است. این پژوهش با استفاده از روش پژوهشی توصیفی تحلیلی به انجام رسیده است بنابراین مناسب ترین راهبرد پیش فروش کالای در بازار سنتی و بورس کالا، که با فقه اسلامی منطبق باشد عقد استصناع است و کاربرد آن در بورس کالا بصورت اوارق انجام گیرد، که در این پژوهش تبیین شده است
