Abstract:
In terms of the importance and high position of the family in Islam and the necessity of consolidating this holy institution, part of the arbitration activity is dedicated to family claims. Arbitration has been used to resolve disputes between husband and wife for a long time and has many advantages, but unfortunately, it is only used Most of it in the current laws, unlike the laws of the past, is at the time of divorce. In verse 35 of Surah Nisa, the Holy Quran refers to arbitration in family lawsuits and instructs the relatives of the couple to establish a family peace court after observing signs of disagreement and incompatibility. To create peace and reconciliation between the two sides of the conflict. This strategy is the best way to create harmony and empathy and overcome family challenges and is one of the masterpieces of Islamic Sharia. This research, while explaining the position of arbitration in family affairs, criticizes the functioning of this institution, focusing on the characteristics of family lawsuits, and also criticizes the challenges of this institution, and finally, solutions to create a compromise between couples. and provides consolidation of the family foundation.
